Claim case details.

Mr Y, a forklift driver from Leicestershire, was injured in an accident at work in December 2012.

Mr Y had been working the night-shift when he had an accident in which he sustained a broken elbow and suffered a sprained wrist.

He had been asked for help by a colleague who had been experiencing a problem with a task he was performing. After helping his colleague resolve his problem he turned to walk back to his work area.

Unfortunately while he had been assisting his colleague a forklift had been parked behind him with raised forks. As he turned to walk off, he tripped and fell over the forks which were raised to shin height, he fell to the floor suffering injury.

He contacted our work injury team to make a claim for his pain & suffering and for his loss of earnings after having to take time off work.

We were able to investigate to establish the facts of his accident proving that his employer was a fault. We were able to show the forklift had been moved while he had been busy helping a colleague, and that because the yard where he was working was poorly lit it was impossible for him to see the vehicle's raised forks as he turned to walk away.

We were able to prove his employer's liability and a settlement was agreed totalling £7,500, which was made up of £2,000 for his loss of earnings and £5,500 for his pain and suffering.
