Road users have a duty of care.

All road users are obliged to take reasonable care to avoid doing something that they anticipate could cause injury to another. Road users are required to drive with ordinary care and skill, a driver who fails to do this and causes an accident is in breach of their duty of care and has been negligent in their actions.
