The 34 year old female employee was heading downstairs with a empty tray when she slipped and fell. Previously the same employee had complained how dangerous the stairs were, highlighting the fact the rubber strips at the edge of the stairs were unsafe because they were coming loose.
While her employers had removed the strips, they had failed in their duty of care to replace the strips which left metal exposed. It was the exposed metal which caused the waitress to fall and injure herself.
