Protective Award for 63 ex-employees of Clockfair Ltd

We are very pleased to have successfully claimed Protective Awards from the Insolvency Service in relation to their redundancy from Clockfair Ltd t/a Broadway Casino, in Birmingham.

Clockfair advised its staff in December 2022 that the company had been placed in administration. Without the proper consultation process, employees were made redundant, and the business closed its doors in the same month. Administrators were appointed in February 2023.

Even though Clockfair Ltd was deemed insolvent, our lead solicitor for Protective Award claims, Philip Jackson, instigated tribunal proceedings to pursue a Protective Award Claim.  Permission was granted, and Imperium Law then brought a claim for up to 8 weeks’ pay for each of our 63 clients in a group claim.

In April 2024, the Tribunal found that Clockfair Ltd had failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992, setting the Protected Period at 90 days from 21 December 2022. Subsequently, funds were received from the Insolvency Service for each of our 63 clients in accordance with their individual circumstances.

Protective Awards are compensation for being made redundant without the proper consultation process being carried out within the required time limits.  To qualify for a Protective Award Claim there is also a requirement for the quantity of employees affected to be more than 20 from the same geographical location.  It is not necessary to be part of a Trade Union to make a Protective Award claim.
