NIHL claim case example:

For a decade Mr D from Devon worked in the engine room of ocean going tankers. During this period his employer failed to offer him any ear protection or warn him of the risk of hearing loss.

For over 10 years he was exposed to excessive noise which came from both steam turbine engines and other noisy machines.

Over time he noticed a reduction in his ability to hear and so visited a medical expert, he was examined and tests were conducted to establish if his hearing was damaged and the extent of his loss.

Examination proved that he was suffering from NIHL and so Mr D decided to make a claim against his employer who should have protected him from harm at work.

A settlement of £5,500 was agreed, this sum would have been around £10,000 but was reduced because for half of the time he was employed in engine rooms, shipping companies were not liable for employees hearing loss.
