Claim case details.

Ms R from London was injured at her local hospital in July 2012 when she slipped on a wet corridor floor.

As a result of the accident, the injured woman suffered soft tissue damage to her wrist which she was advised would take up to 10 months to fully heal.

Our Public Liability team were contacted by Ms R who wanted to find out about making a claim against the hospital for their failure to notify people of the potential hazard.

Their failure to adhere to the cleaning policy and post signs notifying the public of a wet floor hazard resulted in her fall and subsequent injury.

After a review of her claim, we advised there was a case for compensation and were retained to act on her behalf.

The hospital denied liability for her injuries stating that a cleaning in progress sign had been in place. Investigation by our team revealed that while a cleaning policy was in place it was not for the corridor area where Ms R slipped and was injured, but for an area within the disease control ward.

We were able to show that the hospital was at fault which led to an admission of liability and a recent compensation payout of £3,375 in settlement for her pain and suffering.

Making a claim after an accident in a public place.

Any area or premises which can be used by the public may be classed as a ‘public space’, and people who are injured in these spaces because of for example poor maintenance, are entitled to make a claim against the persons responsible for the area.

Claims are made against Public Liability Insurance and all premises are required to have this cover in place.

If you have slipped on a wet floor, on ice on a public pathway, fallen down a pothole on a public road or tripped over an obstacle in a shop, you are entitled to make a claim if the accident was not your fault and you suffered an injury as a result.
