Cancer Misdiagnosis Claims

If you or a loved one has been misdiagnosed because your doctor failed to detect your cancer, solicitors at Imperium Law can help you make a claim.

We represent cancer claim patients who have suffered delayed treatment because of misdiagnosis, and family members who have lost loved ones because their cancer was detected too late.

Statistics from Cancer Research UK show that each year bowel cancer accounts for around 10% of all UK deaths.

Any delay in detecting bowel cancer can be devastating, and in some cases failure to promptly diagnosis the disease can be fatal.

Symptoms to look out for include:

  • Blood in the stool or rectal bleeding

  • A change in bowel movements

  • Diarrhoea, incontinence, constipation and passing mucus

  • Unexplained weight loss

In addition you may experience abdominal pain, bloating, anaemia, lethargy and vomiting. These symptoms can be attributed by your GP to other conditions and so it is important that your doctor takes a detailed history and investigates your symptoms thoroughly. Failure to do this can be grounds for a claim.

Early detection and treatment is therefore essential, however sadly not all cases are detected, and left untreated bowel cancer can be terminal.

We strongly believe in representing our clients on a No Win-No Fee basis because that way every person can pursue their rights.

Everyone deserves compensation for the pain, suffering and distress caused by negligent treatment from a medical professional.

By representing our clients on a ‘No Win-No Fee’ basis, we ensure there is need to worry about the financial costs of making a claim and highlighting medical failings.

You only pay a fee if we win your case and you are awarded a payout.

As well as getting a payout to help with your or a loved ones recovery, or to compensate you for the death of a loved one, there is another reason to make a claim.

By claiming you can help improve treatment for all patients, because pointing out medical failings can help prevent others from experiencing a similar fate.

Compensation for delayed diagnosis

Statistics show that if detected at its earliest stage, the 5 year bowel cancer survival rate is 90%. Any delay in the diagnosis of the disease can therefore have very serious consequences.

Whilst bowel screening has vastly improved over the last two decades mistakes happen.

If you are told your screening results are negative and your doctor fails to make an accurate diagnosis, cancer can be left unchecked and can spread through the bowel wall into other parts of the body.

If this describes your situation or that of a loved one, call a solicitor at Imperium Law on 0800 633 5730. We can review your claim and advise if you could be entitled to a payout.

Making a cancer claim.

To make a successful claim it is necessary to show that you were misdiagnosed, and that the delay directly caused your condition and eventual medical outcome to worsen.

To prove your claim it will be necessary to show:

  • The standard of care provided fell below the standard of care expected of a qualified GP or clinician.
  • The delay directly caused an adverse outcome.

Compensation amounts vary according the physical effects, and depend on the stage you were at when you should have been diagnosed and the stage you were at when you were finally diagnosed. This can be mapped by an oncologist and the information used to help prove your claim and work out how much compensation you are entitled to receive.

If you would like to make a claim call us on 0800 633 5730 and we can review your case.
